Terms and Conditions

Price and Payment

Validity Period is 10 Days.
Our offer includes custom clearance and local charges in the UAE only.
Quoted Price covers transport and delivery within the UAE.
Unless otherwise agreed in writing, a deposit of Seventy percent (70%) Non-Refundable advance payment shall be made on all furniture orders with the Thirty percent (30%) balance due 10 working days prior to the delivery of the Goods.
If the outstanding balance of payment is not received by the due date, KENSHO DESIGNS DECOR L.L.C. reserves the right to delay delivery until full payment is made. If payment is not made in cleared funds within ten (10) working days from the due date, KENSHO DESIGNS DECOR L.L.C. reserves the right to cancel all orders and retain any and all deposits paid.
Our prices may change at any time however all orders which have been confirmed by payment of a minimum 50% deposit will not be variable.
All goods remain the property of KENSHO DESIGNS DECOR L.L.C. until full payment has been received. As a consequence, in the event of the purchaser failing to pay the seller, the latter expressly reserves the right to retain the goods.

Exchanges and Returns

no cash or credit refunds shall be made once an invoice or deposit receipt is generated.
no exchange, refund, or credit note will be accepted on special orders, goods purchased at a discount, accessories, furniture already assembled, upholstered furniture, or any products damaged due to customer misuse.
Refunds will only be provided for defective goods if repair or replacement options are unavailable. Repair or exchange of the goods is available for production defects only.
The client should inform KENSHO DESIGNS DECOR L.L.C. in writing before the signing the delivery note, if any manufacturing defect is found after delivery, KENSHO DESIGNS DECOR L.L.C. will not accept any complaints reported after the mentioned time period.

Cancellations

Advance Payments: A deposit of Seventy percent (70%) is required to commence production of custom orders. This deposit is non-refundable under any circumstances.
Cancellation Requests: Should a customer wish to cancel an order, the request must be made in writing. KENSHO DESIGNS DECOR L.L.C. reserves the right to retain any and all payments made up to the date of the cancellation request.
Please note that transport charges, custom fees, and taxes, if any that are incurred at the time of the purchase, are non-refundable.

Reservation & Storage

Goods will be stored free of charge for one week. After this time, charges of AED 15 per CBM Cubic Meter Space Occupied per Day will be applied. Delivery will not take place until the storage charges have been paid in full.

Customizations and Modifications

The customer may request a modification to their order by sending the request in writing prior to the goods entering into production.
Once the order placed by the customer cannot be modified, exchanged, returned, or refunded.
Color shade of yarn, fabrics, leather, stone and wood of the same product may have slight variations from batch to batch. Colors may also change with age and exposure to sun and other climatic conditions.

Shipping, Delivery & Installation

Upon placement of order, KENSHO DESIGNS DECOR L.L.C. shall give the receiver an estimated delivery date for the goods, which shall be offered as guidance only.
A surcharge will be applied for furniture to be transported via crane, air freight or courier.
When the receiver's goods are ready for delivery, KENSHO DESIGNS DECOR L.L.C. will contact the receiver to agree on a delivery date on the contact details provided. Once a delivery date has been agreed upon, the receiver will be responsible for accepting the delivery and arranging appropriate means of access and installation on that date. It is the receiver's responsibility to ensure that the KENSHO DESIGNS DECOR L.L.C. delivery team has access to the delivery address and that sufficient space for the goods is available. Delivery on the first floor and above shall be achieved by service elevators arranged by the receiver, and it is the receiver's responsibility to notify KENSHO DESIGNS DECOR L.L.C. of any potential problems with access to the premises, building, service elevators, etc., and make any related delivery arrangements. Where delivery is complicated by such factors, additional charges will be incurred by the receiver.
If the client fails to respond to delivery requests within ten (10) days, KENSHO DESIGNS DECOR L.L.C. reserves the right to cancel the order. In the event of cancellation due to non-responsiveness, all payments made up to that date, including deposits and advances, will be retained by KENSHO DESIGNS DECOR L.L.C. as compensation for administrative and storage costs. Following the cancellation, KENSHO DESIGNS DECOR L.L.C. reserves the right to resell the goods with no further liability to the original client.
It is the responsibility of the client to ensure adequate access to the delivery address. If on the delivery date KENSHO DESIGNS DECOR L.L.C. Delivery team is unable to obtain access to the delivery address, the receiver will incur a re-delivery charge quoted as per the transportation company to take the furniture back to the Storage warehouse and for redelivery, which must be paid prior to re-delivery.
If the receiver fails to agree a revised delivery date within ten (10) days of KENSHO DESIGNS DECOR L.L.C. Delivery request, KENSHO DESIGNS DECOR L.L.C. Retains the right to cancel the receiver's order, retain all amount paid and resell the goods with no further liability.
KENSHO DESIGNS DECOR L.L.C. Team will not disassemble, pack or shift furniture existing in the client's premise. Client needs to make arrangements to clear any existing furniture.
KENSHO DESIGNS DECOR L.L.C. Will not be responsible for any potential delivery problems including vehicle access to site, narrow stairs and doors, small service lifts, low ceilings or any other barriers. Removal or avoiding of any barriers to make delivery possible is solely under client’s cost and risk.
If delivery is not accepted on the agreed delivery date, goods shall be kept in storage free of charge for a period of up to Seven (7) days. If you fail to agree a revised delivery date within ten (10) days of KENSHO DESIGNS DECOR L.L.C. Redelivery request, KENSHO DESIGNS DECOR L.L.C.Retains the right to cancel your order, retain all monies paid and resell the goods with no further liability.
KENSHO DESIGNS DECOR L.L.C.Do not accept any responsibility for damage to client's property during delivery other than damage due to our negligence and our liability is limited to the repair of that damage.
In the absence of negligence, KENSHO DESIGNS DECOR L.L.C. Will not be liable for loss or damage to the goods or your property caused by (i) KENSHO DESIGNS DECOR L.L.C. following your instructions; (ii) limited or no access to the premises; and/or (iii) goods not fitting into your property.
For Shipments outside UAE, a packing list, shipping documents will be issued by KENSHO DESIGNS DECOR L.L.C., Customs Duty, Clearance Charges any VAT (if any) will need to be paid by the receiver upon delivery.

Acceptances

The receiver or responsible person with appropriate ID acting on the receiver's behalf will be asked to inspect the goods and sign the delivery documents to acknowledge delivery and/or installation. Goods will not be released without signing the delivery documents acknowledging inspection of goods. The receiver's appropriate ID will hereby agree to remain responsible in accordance with these Terms and Conditions notwithstanding that the receiver may have nominated a third party to receive goods on your behalf. On availability of the nominated personnel will result in delivery cancellation and re-delivery will be made with a surcharge. KENSHO DESIGNS DECOR L.L.C. will notify the client in writing with regards to the surcharge involved.

Prior to signing the delivery note, KENSHO DESIGNS DECOR L.L.C. requires the recipient to examine the goods carefully and report any error, damage, or defect on the delivery documents. Only defects reported on the delivery documents will be acknowledged by KENSHO DESIGNS DECOR L.L.C.

Unavoidable Delays

KENSHO DESIGNS DECOR L.L.C. will not be liable for any delay or failure in performing KENSHO DESIGNS DECOR L.L.C. obligations where the delay or failure results from any act, event, or accident beyond KENSHO DESIGNS DECOR L.L.C. control, including but not limited to war, terrorism, sabotage, civil or military disturbance, fire, explosion, storm, flood, earthquake or other natural disasters, strikes, lock-outs or import/export embargoes, or the impossibility of KENSHO DESIGNS DECOR L.L.C. using railways, shipping, aircraft, motor transport, or other means of public or private transport. If such circumstances arise, KENSHO DESIGNS DECOR L.L.C. will use all reasonable efforts to notify you.

Intellectual Property Rights

We will not release drawings and/or plans until we have received a confirmed order and relevant deposit or until the design fee has been paid in full. We retain the copyright, design rights, and all other intellectual property rights of the goods, drafts, drawings, and/or illustrations we make in connections with any design services.

Warranties

Custom Orders: Custom-made items are crafted according to the customer's specific requirements and preferences. As such, no guarantees are provided regarding their performance, durability, or suitability for a particular purpose.
Natural Variations: Due to the natural variations in materials (such as wood, fabric, and leather), slight differences in color, texture, natural cracks and grain may occur. These variations are not considered defects and are not covered by any guarantee.
Usage and Care: Proper usage and maintenance of products are the responsibility of the customer. KENSHO DESIGNS DECOR L.L.C. does not guarantee the longevity or performance of products subjected to misuse, neglect, or improper care.
Repair: there will be delivery charges quoted as per the transportation company , plus expenses and any costs of repair or replacement for repairing certain types of defects reported after the time of delivery.
We cannot accept the return of made-to-measure goods if incorrect measurements have been provided by the customer.

Legal Effects

Your signature on the sales order form receipt confirms that you have read, understood, and agree to be bound by these Terms and Conditions.
If any part of these Terms and Conditions are found to be unenforceable, it will not affect the enforceability of the remainder of the terms, conditions, and obligations of the parties.
These Terms and Conditions shall be governed by the laws of Abu Dhabi in the United Arab Emirates.
These Terms and Conditions are personal to the individual customer and cannot be relied on by any third party.
These are KENSHO DESIGNS DECOR L.L.C. Terms and Conditions, and in the absence of express wording signed by both parties on the front of the sales order, these Terms and Conditions shall take precedence over all other terms and conditions.
In case a customer has made an advance payment to KENSHO DESIGNS DECOR L.L.C. without a signature on the quote, the above Terms and Conditions will automatically take into effect and govern the terms of the contract.
